Dining Out NYC

New Yorkers, have no fear, Dining Out is here to stay. Mayor Eric Adams has signed Intro. 31-C into law and unveiled “Dining Out NYC” - NYC’s permanent outdoor dining programs and largest outdoor dining program in the nation.

Outdoor dining saved nearly 100,000 jobs and kept the city alive during the COVID-19 pandemic. The intention is to create vibrant outdoor spaces for restaurants to be able to operate in. We’ve learned a lot through the years about what works well and what doesn’t with outdoor dining, and this law looks to act on the best points and emphasize those.

There are type different styles of outdoor dining setups a restaurant can apply for, either Roadway Cafes or Sidewalk Cafes.

Roadway Cafe:

  • Accessible, lighter, open-air cafes that extend the restaurant's look and feel out to the street

  • Cafes will be easy to move, clean, set up, and break down

  • Allowed April through November (eight-month season)

Sidewalk Cafes:

  • Intended to look and feel like a traditional sidewalk cafe 

  • Year-round sidewalk cafes

  • Reduced fees compared to previous Sidewalk Cafe program
